Guide to Probate Prices
At Brindley Twist Tafft and James, there are several ways in which we can help you through the difficult process of administering the estate of someone who has died.
We can deal with the whole of the administration of the estate for you (this means we can ascertain the assets of the estate and obtain valuations for you, apply for the grant and collect and distribute the assets) or we can act for you on a “grant only basis”. The grant is the document issued by the court that allows the executors or administrators to collect or transfer the assets from third parties eg banks.
We are very happy to discuss the basis on which we can act for you and tailor our service to your requirements.
Our solicitors can act where there is a valid Will, or where the person who died had no Will (this is known as intestacy) and we can help with estates where there is inheritance tax to pay or with non-taxable estates. Whether inheritance tax is payable will depend on the value of the estate and whether any gifts have been made during the lifetime of the person who has died. We can advise you on this once we have spoken to you and have more details. Dealing with the whole of the estate administration where there is a valid Will
Our service is completely bespoke to you.
If you instruct us to deal with the whole of the estate for you, we will:
ascertain the assets of the estate and obtain valuations for you
prepare the papers to apply for a grant of probate
obtain the grant for you
collect and distribute the assets
pay any liabilities
Where appropriate we will also arrange for the inheritance tax to be paid (usually from assets in the estate or by way of executors loan).
Dealing with the whole of the estate administration where there is no valid Will
Where there is no inheritance tax to pay: On average, estates that fall within this range are dealt with within 6 to 12 months. Typically obtaining a grant of probate takes 2 to 5 months. Collecting assets and paying liabilities then follows, which can take between 2 and 4 months. Once this has been done, we can prepare the estate accounts for the executors’ approval and distribute the assets, which normally takes 2 to 3 months.
Where there is inheritance tax to pay: On average, estates that fall within this range are dealt with within 12 to 18 months. Typically obtaining a grant of probate takes 5 to 6 months. Collecting assets and paying liabilities then follows, which can take between 2 and 4 months. Once this has been done and HMRC have confirmed there is no further inheritance tax to pay (or any income or capital gains tax for the pre-death and administration period) we can prepare the estate accounts for the executors’ approval and distribute the assets, which normally takes 5 to 8 months.

prepare the papers to apply for a grant of letters of administration
obtain the grant for you
collect and distribute the assets
pay any liabilities
We may also discuss with you making checks to ascertain the beneficiaries of the estate and their entitlement to the estate.
Where appropriate we will also arrange for the inheritance tax to be paid (usually from assets in the estate or by way of an administrator’s loan).
Applying for the Grant where there is no inheritance tax to pay
At BTTJ our service is completely bespoke to you and sometimes clients wish us to act for them on a more limited basis as they feel able to ascertain the value of the assets themselves, but do not feel comfortable dealing with the actual probate application.
In these cases, we can act for you on a grant only basis. You provide us with all the values of the assets (you take responsibility for providing the correct information) and we then complete the documents to apply for a grant. This normally consists of: –
